Terms of Service

These Terms of Service ("Terms") govern your access to and use of bandor.xyz (the "Site") and your purchase of products from Bandor Management FZCO ("Bandor", "we", "us"), a company registered in the UAE (Trade License No. 30875), Premises No. 30875-001, IFZA Business Park, DDP, Dubai, United Arab Emirates. By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. By ordering, you confirm that the payment method — fiat or crypto — is lawfully yours and that your purchase complies with the laws of your jurisdiction.

2. Products

Bandor sells made-to-order luxury jewelry in 18k gold, platinum, and precious stones. Each piece is numbered, serialized on-chain (ERC-721), and issued with a certificate of authenticity. Production begins after order confirmation.

Product images are crafted to represent each piece faithfully, but as fine jewelry is handmade, minor variation in stones, finish, and tone is inherent and expected and is not a defect. Colors may also vary with your screen.

3. Pricing & payment

  • Prices are listed in USD unless otherwise shown and exclude import duties and taxes (see Shipping Policy).
  • We accept card / fiat payments and direct payment in APE cryptocurrency.
  • Crypto payments are arranged directly with Bandor. On request, we provide a USD-denominated quote valid for 15 minutes and a Bandor-controlled wallet address communicated only through our official channel (hello@bandor.xyz). We will never send you a wallet address through an unsolicited direct message on Discord, Telegram, X, or any other channel — treat any such message as a scam. Only the address confirmed by us by email is genuine.
  • Crypto transactions are irreversible. You are responsible for sending the correct amount, on the correct network, to the correct address, within the quote window. Bandor is not liable for losses caused by user error, sending to a wrong or fraudulent address, wallet compromise, network failure, or price volatility. See our Disclaimer.
  • Compliance. For crypto payments, we may request identity verification (KYC) before confirming an order, and we may refuse or refund any payment whose source we cannot verify or which fails sanctions / anti-money-laundering screening.
  • We reserve the right to refuse or cancel any order, including for suspected fraud, pricing error, sanctions/compliance reasons, or stock limitation. If we cancel a paid order, you are refunded per the Refund Policy.

4. Orders, cancellation & refunds

Order confirmation forms a binding contract. Cancellation, returns, defects, and refunds — including the 72-hour pre-production cancellation window and the crypto refund method — are governed by our Refund & Cancellation Policy, incorporated by reference.

5. NFT, on-chain serialization & intellectual property

  • Each piece is serialized on-chain as an ERC-721 record evidencing authenticity and edition. Ownership of the physical piece is distinct from any rights in the underlying artwork, brand, or smart contract.
  • The Bandor name, logo, "Bandorverse", designs, lore, text, and imagery are the intellectual property of Bandor and may not be reproduced, resold commercially, or used to create derivative works without written permission.
  • Bandor's use of Bored Ape Yacht Club elements is licensed under Made by Apes license #00612007423. Purchase of a physical piece grants you no rights in BAYC IP, the Made by Apes license, or any third-party intellectual property.
  • You receive personal ownership of your physical piece and may resell it; the on-chain record and certificate are intended to travel with the piece, but Bandor does not guarantee any resale value, liquidity, or market for any piece.

6. No investment / no financial advice

Bandor products are luxury goods and collectibles, not financial instruments, securities, or investments. Nothing on the Site is investment, financial, legal, or tax advice. Scarcity, editions, and on-chain features are brand and authenticity features and are not a promise of appreciation or return. See our Disclaimer.

7. Acceptable use

You agree not to use the Site unlawfully, to interfere with its operation, to scrape or harvest data, to infringe our IP, or to use Bandor in connection with money laundering, sanctions evasion, or any illicit activity. We may suspend access for breach.

8. Warranties & disclaimers

Beyond the express warranty in our Refund Policy, the Site and products are provided "as is" to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free. Nothing in these Terms excludes liability that cannot lawfully be excluded, including statutory rights of consumers in the EU and UK.

9. Limitation of liability

To the fullest extent permitted by law, Bandor's total liability arising out of or relating to any order or these Terms is limited to the amount you paid for the product concerned. We are not liable for indirect, incidental, or consequential damages, or for losses relating to cryptocurrency value, wallets, blockchain networks, or third-party processors.

10. Indemnity

You agree to indemnify Bandor against claims arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Dispute resolution

11.1 Talk to us first. Most issues are resolved quickly. Before starting any formal proceedings, you agree to contact us at hello@bandor.xyz with a description of your concern and your order number, and to allow 60 days of good-faith discussion to resolve it. We will do the same before bringing any claim against you.

11.2 Governing law. These Terms and any dispute arising from them or from your purchase are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without prejudice to mandatory consumer-protection rights in your country of residence.

11.3 Jurisdiction. Disputes are subject to the competent courts of Dubai, UAE. However, if you are a consumer resident in the EU, the UK, or another jurisdiction whose mandatory law gives you that right, nothing here deprives you of the right to bring proceedings before the courts of your country of residence, under the law of that country.

11.4 Payment & chargeback disputes. If you have a problem with a charge, please raise it with us before opening a chargeback or bank dispute — we can almost always resolve it faster directly. Opening a chargeback for an order that has shipped or entered production, outside the terms of our Refund Policy, may be treated as a breach of these Terms.

11.5 Time limit. Any claim relating to an order must be brought within one (1) year of the event giving rise to it, except where a longer period is required by mandatory law.

12. Changes

We may update these Terms. The version in force is the one published on the Site at the time of your order. Material changes take effect on posting.
